For and in consideration for my participation in UNDERDOG SPORTS LEAGUES'  league (hereinafter the LEAGUE), I hereby, for myself, my heirs, executors, insurers, successors and administrators assume any and all risks associated with my participation in the LEAGUE and unconditionally, knowingly and voluntarily release and waive any and all rights and claims that I may now, or in the future, have against UNDERDOG SPORTS LEAGUES, the LEAGUE, and their respective subsidiaries, agents, employees, directors, officers, representatives, contractors, sponsors, affiliates, successors and assigns (collectively the ‘Released Parties’), arising out of my participation in the LEAGUE and/or any related activities (such as activities staged and/or sanctioned by the LEAGUE) (collectively, the “Events”). I hereby fully release and discharge the Released Parties from any and all claims for injuries, death, damage, or loss of any kind which I may have or which may accrue to me from my participation in the LEAGUE and/or Events, even though that liability may arise out of the negligence, carelessness or other conduct on the part of the Released Parties. I acknowledge that the Released Parties are not responsible for any inclement weather which may affect the Events and release and waive all claims against the Released Parties for damage, liabilities or loss of any kind that may arise therefrom.

This waiver and release is intended to be as broad and inclusive as permitted by law, and if any portion hereof is held invalid, it is agreed that the balance shall notwithstanding, continue in full legal force and effect. This waiver and release embodies the entire agreement with respect to these matters and supersedes any previous or contemporaneous negations or agreements. Each of the undersigned agrees that no promise or inducement has been offered except as herein set forth, and that this waiver and release has not been executed based on statements or representations by any person or entity other than those set forth herein. I have been advised to contact an attorney prior to execution hereof. This document shall be governed by and construed under the laws of the state of Washington without regard to conflicts of law principles herein.

1.     The risks of injury and illness (ex: communicable diseases such as MRSA, influenza, and COVID-19) from the activities involved in this program are significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce these risks, the risks of serious injury and illness do exist; and,

2.     I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,

3.     I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,

4.     I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS the LEAGUE their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
 

As a condition to participation in the League (i) I agree to abide by the rules of the game, all UNDERDOG SPORTS LEAGUES’ policies and rulings by referees or officials; (ii) I acknowledge that UNDERDOG SPORTS LEAGUES will not disclose to me the name, address and telephone number of any other participant in the LEAGUE; and (iii) I agree and acknowledge that UNDERDOG SPORTS LEAGUES is the exclusive owner of all copyrights and other proprietary rights in the game and game information, and UNDERDOG SPORTS LEAGUES shall have the unrestricted right to use my identity, likeness and/or voice in any audio, video or photographic recording of the game and associated promotional materials and events.

I HAVE READ AND FULLY UNDERSTAND AND VOLUNTARILY EXECUTE THIS WAIVER, AND RELEASE.
